Legal Guarantee of Conformity
Article L 217-4 of the Consumer Code: The seller shall deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery. The seller shall also be liable for any lack of conformity resulting from packaging, assembly instructions, or installation when it is their responsibility under the contract or was carried out under their responsibility.
Article L 217-5 of the Consumer Code: The goods shall be considered conforming to the contract if they: 1/ Are fit for the usual purpose of goods of the same type and, where applicable: • Correspond to the description given by the seller and have the qualities presented to the buyer in the form of a sample or model; • Have the qualities that a buyer can reasonably expect, given the public statements made by the seller, the producer, or their representative, in particular in advertising or labeling. 2/ Or if they have the characteristics mutually agreed upon by the parties or are suitable for any special use sought by the buyer, which was brought to the seller's attention and accepted by them.
Article L. 217-7, paragraph 1, of the Consumer Code: Any lack of conformity that appears within twenty-four months from the delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise.
Article L. 217-9 of the Consumer Code: In case of a lack of conformity, the buyer may choose between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. The seller must then proceed, unless impossible, according to the option not chosen by the buyer.
Article L 217-10 of the Consumer Code: If repair and replacement of the goods are impossible, the buyer may return the goods and receive a refund, or keep the goods and receive a partial refund. The same option is available: 1/ If the chosen solution, proposed, or agreed upon under Article L. 217-9 cannot be implemented within one month following the buyer's complaint; 2/ Or if this solution cannot be implemented without major inconvenience for the buyer, considering the nature of the goods and the intended use.
However, the resolution of the sale cannot be pronounced if the lack of conformity is minor.
Article L 217-11 of the Consumer Code: The application of Articles L. 217-9 and L. 217-10 shall be made at no cost to the buyer. These provisions shall not prevent the awarding of damages and interest.
Article L 217-12 of the Consumer Code: Any action arising from a lack of conformity shall be time-barred two years from the delivery of the goods.

In accordance with Article 21 of these General Terms and Conditions, the Client shall first contact RINCICA to seek an amicable solution when invoking any of the aforementioned guarantees. This guarantee allows the Client to return defective or non-conforming delivered items for a refund under the aforementioned conditions.
