It is also to define rights and obligations about sales of products by RINCICA to consumers. They apply, without restriction, nor reservation, to all sales via newangance.com.
Buying products through the website www.newangance.com means customers have read and accept all the terms and conditions before ordering.
RINCICA has the possibility and rights to modify, at any moment, the present terms and conditions. However, the applicable terms and conditions are what buyers accept when placing orders.

Article 3 – Formation of contract and orders
The price indicated in euros on the website www.newangance.com is the price that customers pay when they make orders. The price can be modified by RINCICA at any moment. The modification will be notified to customers before payment. The prices are applicable for distance selling.
The prices do not include delivery fee. Delivery fee will be indicated in the invoice and will be indicated to customers before they confirm their orders. Different ways of delivery are indicated in this terms and conditions and will also be notified to customers before they confirm their orders. It might be modified by RINCICA at any moment. RINCICA suggests all customers consult the terms and conditions regularly on this website.
The prices shown include tax. RINCICA will change the prices according to changes of applicable VAT.
When the order is to be posted to some countries other than metropolitan France, you are the importer of the product (s) concerned. Customs duties, other local taxes, import duties or state taxes might be required. These costs are not charged by RINCICA. It will be your responsibility to make payment to the concerning authorities in your country (if applicaple). We advise you to consult local rules in your state/country to determine if tax will be required upon delivery of goods.
All orders are to be paid in euros. RINCICA reserves the right to modify prices at any time. The product will be charged at the price indicated at the moment when you pass a valid order and the product is in stock. The product(s) remain(s) the property of RINCICA until we receive full payment. Caution: As soon as you receive the products ordered, the risks of loss or damage of the products are transferred to you.
3.2 Characteristics of products
Buyers can choose one or several products in different categories of the website www.newangance.com.
RINCICA may modify at any time the assortment of products offered for sale on its website, depending on products’ availability, without prejudice to buyer.
In accordance with Article L. 111-1 of the Consumption Code, buyers can get information about essential characteristics of the product(s) that they want to buy on the www.newangance.com website before placing an order.
All products are in conformity with French legislation. RINCICA is not responsible if products are non-compliance with the laws of the country in which the product will be delivered. It is the buyer's responsibility to check with the local authorities about the possibilities of importing or using the products that he/she plans to order.
RINCICA can not guarantee that the information contained on the product packaging is translated into all the languages of the European Union. However, the information is available at least in French and/or in English.

Offers presented by RINCICA are valid as long as they are advertised on the site and products are at the limit of available stocks. Information on the availability of the products is provided to the buyer at the time of placing his Order. Errors or modifications can exceptionally exist.
In any case, such as total or partial unavailability of products after the order has been placed, the buyer will be informed by e-mail as soon as possible of the unavailability of the product and the total or partial cancellation of the order.
In case of partial cancellation of the order:
- The buyer's order will be validated and his bank account will be debited for the entire order;
- The buyer will be delivered available products;
- The buyer will be refunded the price of the ordered unavailable products as soon as possible, no more than 30 days after the payment of client.
All Orders constitute acceptance of the present Terms & Conditions, without prejudice to the specific contractual conditions concluded between the Parties.
Before validating his/her Order, the buyer can check the details of his order and correct any errors.
The distance selling contract is concluded from the moment when the buyer confirms his order by clicking on the icon "I confirm my order" he is considered to have accepted the terms & conditions, prices, volumes, characteristics, quantities and delivery times.
Once this step is validated, the buyer can no longer cancel his Order. If buyer doesn’t receive confirmation email because he/she registered a wrong email address, RINCICA has no responsibility. In this case, the sale will be considered as final, except in case of cancellation of the order by RINCICA, in particular because of unavailability of the products. The buyer may nevertheless exercise his/her right of withdrawal under the conditions provided for in article 6 of these General Conditions of Sale.
RINCICA will be entitled to charge the full price of the Order:
- With regard to payments made by RINCICA Gift Cards and / or vouchers and / or online credits: upon confirmation of the Order;
- With regard to payments made by the other payment methods accepted on the website in accordance with Article 4.1 below: counting from the sending of the e-mail informing the buyer of the shipment of his Order.
It is recalled that the purchases made on the website are reserved to non-professional individuals for their own use (or for gift purposes in the family circle), that is why RINCICA sells its products only in quantities corresponding to the usual average requirements of a family. In accordance with Article L121-11 of the Consumption Code, RINCICA reserves the right to refuse or cancel for any legitimate reason any Order of which quantity of products or the amount to be paid (for one or more cumulative orders) does not correspond to the usual average use of a family, any Order which seems that an economic activity is carried out by the buyer or, more generally, any abnormal Order violating relevant laws.
Finally, RINCICA reserves the right to suspend or cancel any execution of an Order and / or delivery, whatever its nature and level of execution, in case of non-payment or partial payment of any sum due to a payment incident, or in case of fraud or attempting fraud relating to the use of the RINCICA Site, including previous Orders.
Article 4 – Payment
The buyer can pay his/her Order on the website under the conditions mentioned below. The buyer guarantees to RINCICA that he/she has the necessary authorizations to use the method of payment that he/she has chosen for his/her Order, at the time of making the Order.
4.1 Online payment methods
Newangance.com only accepts PayPal payment. The Customer complies with the conditions of use presenting on www.paypal.com. The customer acknowledges and agrees that when he/she pays with Paypal, the amount of his/her payment will be debited from his/her account at the time of the validation of his/her order.
The payment of all purchases must be made at the time of making orders online. The site newangance.com does not accept any down payments. Orders will be paid in EUROS and newangance.com reserves the right to cancel any order or delivery in case of a payment incident.
Newangance.com and RINCICA remain the owner of the ordered product until it is fully paid.
Buyer may use his PayPal account to pay for his Orders on the Site.
4.2 Other Payment methods
All Orders involve payment. These Orders are payable in Euros, including all taxes and mandatory contributions. Any bank charges should be paid by the purchaser (including the case of a refund).
Penalties of the same amount as the legal interest rate, may, at the discretion of RINCICA, be fully applied to the unpaid amounts after ten days counting from the date of the Order or upon notification of the Rejection of bank payment.
RINCICA reserves the right to suspend or cancel any execution of an Order and / or delivery, whatever its nature and level of performance, in case of non-payment or partial payment of any amount due to a payment incident, or in case of fraud or attempted fraud relating to the use of the website, including previous Orders.
4.3 Security in payment transactions
In order to ensure the security of the payment by bank card on the website, the buyer must send to RINCICA the visual cryptogram (CVV) on the back of the bank card used by the buyer.
In the context of the fight against fraud on the Internet, information relating to the Buyer's Order may be transmitted to any third party authorized by law or designated by RINCICA for the sole purpose of verifying the identity of the buyer, the validity of the Order, the method of payment used and the delivery envisaged.
Following this inspection, RINCICA reserves the right to request a photocopy of the buyer's identity card and / or any information relating to the identity of the buyer. All buyers have the right to access, rectify and delete personal data concerning themselves and processed by RINCICA under the conditions provided for.

Article 5 – Delivery and reception
5.1 General rules
Products ordered by the buyer in accordance with these Terms & Conditions will be delivered to the address indicated by the buyer on the relevant Order ("Delivery Address").
RINCICA can ship products to all countries worldwide if our delivery agency agrees to transport.
5.2 Delivery Methods
We offer customers delivery via "Colissimo / Colissimo international".
- Shipment through Colissimo
The parcel containing the products ordered and paid is put in the mailbox of the Delivery address indicated by the buyer.
When the size of the mailbox is too small, the parcel is delivered indoors to the addressee or another person related to addressee, as a coworker, a person living with the addressee or with an authorization letter.
In case the parcel cannot be delivered to the addressee for the following reasons: size of mailbox is too small or addressee is absent. The addressee receives a notice of transit issue of post office. The addressee should go to collect the parcel in the post office indicated in the transit notice with presentation of his/her ID card within 14 days.
If the parcel is not collected before the deadline indicated by post office, it is returned to sender. In this case, the buyer will get the refund for the amount of the Order, delivery charges deducted, by any means, depending on the choice of RINCICA.
No dispute relating to the delivery itself is possible if the package appears as having been delivered, the computer system (flashing) of the Post will be authentic.
- Shippment through Colissimo International
The Colissimo International network is connected with local postal services of each country. The terms of delivery therefore differ from one country to another.
Generally, upon delivery, a distribution slip or acknowledgment of receipt should be signed by the buyer or the addressee of the Order. This acknowledgment of receipt is proof of delivery by RINCICA, and of the receipt by the buyer or the recipient of the products ordered.
In case the parcel cannot be delivered to the addressee because of his/her absence. The addressee receives a notice of transit issue. The addressee can withdraw the parcel in the post office indicated in the transit notice within 10-21 days. However, delivery regulations are different from one country to another. We suggest our clients to consult frequently the delivery status through the link that we send you by email by inputting the tracking number concerned.
If the parcel is not collected before the deadline indicated in the transit notice of post office, it is returned to sender. In this case, the buyer will get the refund for the amount of the Order, delivery charges deducted, by any means, depending on the choice of RINCICA.

5.3 Anomaly, damage, damaged parcel
The purchaser, or the recipient of the Order, is requested to verify the condition of the parcel and the products upon delivery.
In case of an abnormality concerning the package (damaged package, open package, trace of liquid, ...) or product (s) ordered (missing product (s), product (s) damaged), the purchaser or recipient of the Order must imperatively follow the procedures described below which correspond to the terms of the Order. Failure to comply with the appropriate procedure will preclude responsibility of the transporter and RINCICA. In particular, the buyer can not claim any refund. The buyer or recipient of the Order can not also demand RINCICA to post the same products as compensation.
It is also possible for the buyer or recipient of the Order to call the RINCICA Customer Service Department to find out how to return the damaged product (s). The procedure for the return of damaged products which may be indicated by the RINCICA Customer Service will then have to be followed by the buyer. Failing to do this, the buyer can not claim any refund or exchange of the products.
- Procedure that must be followed when the package is damaged:
- Do not open the package if it appears goods have been damaged in transit. Attention: the opening of the package excludes any responsibilities of La Poste and RINCICA;
- Return unopened parcel to Post office within five working days counting from the date of delivery;
- Indicate the refusal of parcel to RINCICA Customer Service on +33 1 44 07 94 63 (Free service + price of the call from France, or +33 1 44 07 94 63 from abroad);
- Establish a "report of spoliation" in post office;
- Indicate the abnormal situation to the RINCICA Customer Service on +33 1 44 07 94 63 (Free service + price of the call from France, or +33 1 44 07 94 63 from abroad);
- The notification of incidents must be made within 3 working days.
5.4 Delivery duration
Delivery time begins from the Order Confirmation time.
The delivery duration for orders to Metropolitan France are as follows:
- Colissimo de la Poste: 2 to 5 working days
- If the order is shipped Corsica, delivery times are extended 1 or 2 more working days
- Delivery duration to other countries depends on the transporter of their local post offices.
Article 6 – Rights and withdrawal periods
In accordance with Article L.121-21 of the Consumption Code, you have a 14-day withdrawal period counting from reception of your products to exercise your right of withdrawal without having to justify reasons or to pay penalty.
Returns are to be made while you guarantee the original status of products (quantity, packaging, accessories, notice etc). In this context, your responsibility is attached. Any damage of the product may make you lose the right of withdrawal. The delivery costs of return are at your expense.
In case when buyer exercise his/her right of withdrawal, RINCICA will process the refund of the sums due, within 14 days after receiving the returned product(s) and via the same means of payment that used during the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with article L.121-21-8 of the Consumption Code, the right of withdrawal does not apply to:
- The services fully executed before the end of the withdrawal period, the execution of which has begun after express prior agreement of the consumer and refusal of customer his right of withdrawal.
- The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period.
- The supply of goods made according to the consumer's specifications or clearly personalized.
- The supply of goods likely to deteriorate or to perish rapidly.
- The supply of goods which have been unsealed by the consumer after delivery and which can not be returned for reasons of hygiene or health protection.
- The supply of goods which, after being delivered and by their nature, are inseparably mixed with other articles.
The products must be returned to RINCICA in a perfect status so that they can be re-commercialized (products in perfect condition accompanied by their original packaging, accessories, notice...) within 30 days counting from their date of reception.
The buyer or recipient of the Order who wishes to exercise his right of withdrawal, legal or contractual, by returning a product by parcel must follow the following instructions:

RINCICA does not accept parcels or letters sent with postage due.
If the buyer of the Order cannot demonstrate that he has deposited the product with a transport agency, any risk related to the return of the parcel is the responsibility of the buyer or recipient of the Order.
Article 7 – Guarantee
All our products have the legal guarantee of conformity and the guarantee of hidden defects, indicated in articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned, exchanged or refunded.
All claims, requests for exchange or refunds must be made through post office within 30 days after the delivery.
The products must be returned to us in the status in which you received them with all the elements (accessories, packaging, notice...). The shipping costs will be refunded on the basis of the invoiced price and the return costs will be reimbursed with presentation of the justifications.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal mentioned in Article 6.
Article 8 – Responsibility
The products offered comply with the French legislation in force. RINCICA can not be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order.
Moreover, RINCICA is not responsible to the damage of product caused by wrong use method.
Finally, RINCICA can not be held liable for all the inconveniences or damages inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.
Article 9 – Applicable law in case of dispute
The language of this contract is English. These conditions of sale are subject to French law. In case of dispute, the French courts will be the only courts competent.
Article 10 – Intellectual property
All elements of www.newangance.com are and remain the intellectual property of RINCICA. Nobody is allowed to reproduce, exploit, rebroadcast, or use for any reason, even partially, any element of the website including software, visual or sound elements. Any simple or hypertext link is strictly forbidden without the written agreement of RINCICA.
Article 11 – Personal data
RINCICA reserves the right to collect your personal data and information. They are necessary to manage your order, as well as to improve the services and information that we offer to you.
They may also be transmitted to other related companies, such as those that are responsible for the execution of services and orders in the aspect of management, processing and payment.
Those information and data is also kept for security purposes in order to comply with legal and regulatory requirements.
In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose your personal data directly on the website.
